Berlin Township Fire Department is a volunteer-based department serving the Berlin Township community and surrounding areas. Our team of trained firefighters and first responders take pride in serving with professionalism, respect, and a strong sense of duty.

Burn Permits

(This permit may be revoked)

I have received, read and understand the laws, ordinances and regulations regarding open burning. I agree to abide by all the laws, ordinances and regulations. I further understand that any violation of such laws, ordinances and regulations may result in the following:

  • Revocation of my Burning Permit
  • Extinguishment of the Open Burning
  • Responsibility for all cost which may be incurred by the Berlin Township Fire Department for such an extinguishment. These costs may include, but not limited to, personnel and responding apparatus. (Under the authority of Part 515 of Act 451 of 1994, The Natural Resources and Environmental Protection ACT.) 


Under the provisions of Part 515 of Act 451 of 1994, as amended, permission is hereby granted this applicant to burn the described acres during the period specified above.
No fire shall be set after the expiration of this permit, and no fire shall be set at a time when a high wind is blowing. An adequate fire line shall be made around the area to be burned and a force of persons, sufficient to control the fire, shall be on hand at time of burning. Permittes shall be liable for all damages to property, which may result from burning done under this permit.

PART 515 OF ACT 453 OF 1994, AS AMENDED, PROVIDES THAT:

  1. You must have a permit to have an open fire except when the ground is snow covered, or for domestic purposes, or to protect persons or property in case of fire.
  2. Any person who sets a fire without taking reasonable precautions to prevent the escape thereof or leaves the fire before it is extinguished is guilty of a misdemeanor.
  3. Any person who maliciously set a fire which endangers human life or destroys the property of another, may, upon conviction, be assessed a fine of not more than $10,000, or imprisonment for a term of not over 10 years, or both such fine and imprisonment.
  4. Any person who negligently allows a fire to escape is liable for all expenses incurred by the State of Michigan in the suppression of such fire.
  5. Any permit issued may be removed if conditions are such that burning may not be done safely.
  6. This permit does not supersede any other Act, Ordinance or Rule which further restricts or prohibits the setting of fires.
